Permanent Residence – Section 26 

A Permanent Residence Visa in South Africa allows foreign nationals to live and work in the country indefinitely, without needing to renew their visa. It provides many of the same rights as South African citizens, except for the right to vote and hold certain public offices. Obtaining permanent residence is a significant step for those who wish to make South Africa their long-term home.

Five Years of Continuous Residence

Applicants who have resided lawfully in South Africa for at least five years on a valid work visa are eligible to apply for permanent residence.

The applicant must show continued employment and good conduct during the period of stay.

This is the most common route for long-term foreign workers.

Spouse of a South African Citizen or Permanent Resident

A foreign national who has been the spouse of a South African citizen or permanent resident for at least five years may apply for permanent residence.

Proof of a genuine, ongoing marriage or relationship is required.

The applicant must not have been separated or divorced during the qualifying period.

Dependent Child of a South African Citizen or Permanent Resident

This applies to a minor child (under 21) of a South African citizen or permanent resident.

The child must be legally dependent and living in South Africa.

Once the child turns 21, they may need to apply for a renewal or change of status depending on circumstances.


Former South African Citizen
    A person who previously held South African citizenship and lost it through acquiring another nationality may apply for permanent residence to return and settle in South Africa permanently.

Permanent residents must not be absent from South Africa for more than three consecutive years, or their status may lapse.

Applicants should retain proof of residence and employment for verification.

Once granted, permanent residence is indefinite but may be withdrawn for non-compliance or fraud.
