A Business Visa allows foreign entrepreneurs and investors to establish or invest in a business in South Africa. This visa is ideal for individuals seeking to contribute to the country’s economic growth while managing their own enterprise. To qualify, applicants must invest a prescribed minimum amount of capital into the business (unless exempted) and demonstrate that the enterprise will benefit the South African economy through job creation or skills transfer. The visa is typically granted for up to three years and may be renewed or used as a pathway to permanent residence for successful business owners.

The Business Visa allows foreign nationals to establish or invest in a business in South Africa and actively participate in its management.

It is aimed at promoting foreign investment, job creation, and economic growth, while ensuring that foreign-owned businesses contribute positively to the South African economy.

A Business Visa is generally issued for a period of up to three years, depending on the nature of the business and supporting documentation. It may be renewed while the business remains active and compliant.

The applicant must invest a prescribed financial capital contribution, currently R5 million or more (unless a waiver is granted).

A comprehensive business plan must be submitted, outlining objectives, structure, and financial projections.

At least 60% of the workforce must consist of South African citizens or permanent residents.

The business must be registered with SARS, the Companies and Intellectual Property Commission (CIPC), and other relevant authorities.

A recommendation from the Department of Trade, Industry and Competition (DTIC) is required before submission to the Department of Home Affairs.

The visa holder must operate only the business for which the visa was approved.

The visa does not automatically authorise work outside the approved business.

Certain sectors may be restricted or excluded from investment (e.g., small-scale trade, security, or labour brokerage), as determined by the Minister of Home Affairs.

The visa may be withdrawn if the business fails to meet investment or employment obligations.

The visa remains valid for the period granted, typically three years, and can be renewed upon proof that the business remains operational and compliant.

Renewal requires submission of audited financial statements, proof of job creation, and evidence that DTIC conditions continue to be met.

After five years of continuous residence on a valid Business Visa, the holder may apply for permanent residence under Section 26(c) of the Immigration Act.
